Whim — Terms of Service
Effective date: 9 September 2026
These terms are an agreement between you and Tevlix LLC ("Whim", "we", "us") for your use of the Whim app. Please read them. Your privacy is covered separately in our Privacy Policy.
1. Accepting these terms
By using Whim, you agree to these terms. If you don't agree, please don't use the app. When we make a material change, we'll ask you to review and accept the updated terms inside the app before you continue.
2. Who can use Whim
You must be at least 13 years old to use Whim. If you're under the age of majority where you live, you may only use Whim with a parent's or guardian's involvement.
3. The service
Whim helps you decide by drawing an option at random from a collection you create. It's a lightweight app provided "as is" — it needs an internet connection to work, and we don't guarantee it will always be available, uninterrupted, or error-free. We may change, suspend, or discontinue features over time.
Whim is in beta. That means features may change, move, or be removed, and interruptions are likelier than in a finished release. Your pockets are real and we look after them the same way either way — beta describes the app around them, not how seriously we take your content.
4. Your account
You can use Whim anonymously. If you choose to save your pockets across devices, you can add your email; sign-in is by a one-time link or code sent to that address, so keep access to your email secure. You may also set a password — that's optional, and the emailed link or code keeps working either way. If you set one, keep it to yourself: anyone who has it can reach your pockets, and we have no way to read it back to you if you forget it. You're responsible for activity that happens through your account.
5. Your content
The pockets, items, notes, and links you create are yours. You keep ownership of them.
You grant us only the limited permission we need to operate the app — to store your content and display it back to you (and sync it to your other devices if you've added an email). We don't claim ownership of your content and we don't use it to advertise to you.
Sharing a pocket. If you share a pocket, you are choosing to give the people you invite access to everything in it — its items, notes, links, and the record of what has been drawn from it — and permission for them to add to and change it. You are responsible for what you choose to share and with whom. Leaving a shared pocket, or being removed from one, does not withdraw content you already added to it. Only the person who created a pocket can invite others to it or delete it.
Acceptable use. You agree not to use Whim to store or share content, or to link to material, that is illegal, infringing, or that violates someone else's rights. We may remove content or limit accounts that break these rules or misuse the service.
6. Links you add
Items can hold a link you paste. Those links, and the sites they open, belong to third parties we don't control. We don't endorse them and aren't responsible for their content or practices. Opening a link is at your own discretion.
7. Paid features
Whim's core is free, and we intend to keep the everyday path — open, tap a pocket, draw — free. Whimsy is our optional paid experience. Buying it never changes what the free app does; it adds to it.
What it includes. Custom pocket looks, a larger pocket allowance, and a larger per-pocket item limit. We may add to what Whimsy includes. If we ever need to remove something from it, we'll tell you first.
How to buy it. Two ways: a monthly subscription, or a one-time purchase that unlocks it permanently. You need a Whim account (an email address) to buy either, so that what you buy follows you rather than living on one device.
Billing. All purchases are billed by the app store you bought through — Google Play or the Apple App Store — under that store's terms. We never see or handle your payment details. Prices are shown by the store in your own currency before you confirm.
Subscriptions renew automatically until you cancel, and cancelling is done in your app store's subscription settings, not in Whim. Cancelling stops future charges; it doesn't refund the period you're already in, and you keep Whimsy until that period ends.
Every plan ends in ownership — the conversion. This is a commitment, not a promotion, so here are its exact terms:
- After 12 paid months, Whimsy becomes permanently yours at no further cost. You do not need to do anything to receive it, and you should cancel your subscription at that point — it will not stop on its own, and we will remind you.
- A paid month is 30 days of subscription coverage that has actually elapsed and has not been refunded. Coverage you have paid for but not yet used does not count until it does. A free trial or a promotional grant is not a paid month, because no money changed hands.
- At several points along the way, the one-time purchase price drops. Which discounted price you're offered is determined by how many paid months you have accrued. Every discounted price is set at or below what continuing to subscribe to the 12-month mark would cost, so buying out early is never worse than waiting.
- If a payment is refunded, the coverage it bought stops counting, and your accrued months go down accordingly. If that takes you back below 12 months, permanent access ends with it.
- If you are charged for a renewal after Whimsy is already permanently yours, that charge was a mistake. We refund it automatically where the store allows us to, and by hand where it doesn't. Contact us if one slips through.
One copy to give away. Once Whimsy is permanently yours, you can generate a single code granting it to one other Whim account, once, for free. A gift can be cancelled while unclaimed; once claimed it belongs to the person who claimed it and cannot be taken back. Receiving a gift doesn't make you eligible to give one — the gift comes with buying.
Refunds are handled by the app store you purchased through, under that store's refund policy. We can ask a store to refund a purchase, but the store decides. Nothing here limits any refund or cancellation right you have under the consumer law where you live.
8. Disclaimers
Whim is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't warrant that the app will meet your needs or be uninterrupted, secure, or error-free.
9. Limitation of liability
To the fullest extent permitted by law, Tevlix LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising out of or relating to your use of Whim.
10. Termination
You can stop using Whim at any time. You can delete individual pockets and items in the app, and you can delete your whole account from its settings — which also deletes the pockets you created, including any you had shared with other people. See the Privacy Policy for exactly what that removes. We may suspend or end access if these terms are broken.
Accounts that go unused. We also close accounts nobody opens, along with everything in them. An account that holds pockets or items is closed after 18 months of inactivity. An account that has never held anything — no pockets, no items, nothing — is closed after 30 days, since there is nothing in it to lose. Opening the app counts as use, and so does making, editing, drawing from, or joining anything; the clock only runs on an account nobody opens. Closing an account removes the same things, in the same way, as deleting it yourself.
An exception: if an account created a pocket that is shared with someone else, we do not close it for inactivity, however long it stays quiet — closing it would take that pocket away from the people still using it.
Because an anonymous account has no email attached, we cannot notify you before this happens. These terms and the Privacy Policy are the notice. Whim should not be the only place something you care about is kept. See "Retention and deletion" in the Privacy Policy for the full description.
11. Changes to these terms
We may update these terms as Whim evolves. Material changes will be surfaced in the app for you to accept before continuing, and the effective date above will be updated.
12. Governing law and disputes
These terms are governed by the laws of Utah, United States, without regard to its conflict-of-law rules.
